If this is not reasonably possible, the general terms and conditions will be available for inspection at Woofsplace and will be sent free of charge as soon as possible at the request of the consumer. <\/li><li>Woofsplace reserves the right to change the terms and conditions in the interim.<\/li><li>The terms and conditions can be accessed at <a href=\"https:\/\/www.woofsplace.nl\">www.woofsplace.nl.<\/a><\/li><\/ol><h2>Article 3: Offers and quotation<\/h2><ol><li>If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer. The offer contains a complete and accurate description of the products and\/or services offered. <\/li><li>All quotations and offers of Woofsplace are without engagement, unless the quotation or offer stipulates a period for acceptance. If no acceptance period is set, the quotation or offer can in no way be relied upon if the product or service to which the quotation or offer relates is no longer available in the meantime. <\/li><li>Woofsplace cannot be held to its bids or offers if the consumer can reasonably understand that the bids or offers, or any part thereof, contain an obvious mistake or slip of the pen.<\/li><\/ol><h2>Article 4: Agreement<\/h2><ol><li>The agreement is established at the time of the consumer&#8217;s acceptance of the offer and the fulfillment of the conditions set forth therein.<\/li><li>If the consumer has accepted the offer electronically, Woofsplace will confirm the receipt of the acceptance of the offer electronically without delay. As long as the receipt of this acceptance has not been confirmed by Woofsplace, the consumer can dissolve the agreement. <\/li><\/ol><h2>Article 5: grooming appointments<\/h2><ol><li>The consumer may reschedule his appointment for the service with respect to the groomer up to 48 hours before the appointment. If the appointment is not rescheduled or canceled in a timely manner, the consumer will owe 50% of the treatment fee. <\/li><li>If the consumer shows up 30 minutes late for the appointment, the appointment will be cancelled and the consumer will owe 50% of the treatment fee.<\/li><li>Dogs must be walked prior to entry. Furthermore, dogs must enter the premises on a leash or in hand. It is therefore not allowed to let the dogs run loose.  <\/li><li>Upon arrival, consumers should be seated in the waiting area in the boutique. Dogs are not allowed on the sofa. <\/li><\/ol><h2>Article 6: Products<\/h2><ol><li>All products purchased through the Woofsplace webshop are subject to the refund and return policy, which can be found on the website.<\/li><li>By ordering a product through the webshop, the consumer expressly agrees to this policy.<\/li><li>When ordering a collar or harness, the consumer may be contacted by Woofsplace by phone about the size of the product.<\/li><\/ol><p><strong>Note: No returns on sale items<\/strong><\/p><p>At Woofsplace, we would like to inform you that all items on sale (sale) cannot be returned. These special offers are sold under the condition that they cannot be returned or exchanged. <\/p><p>We therefore advise you to check carefully whether the item meets your requirements before completing your purchase. Should you have any questions about a sale item, we are of course at your service! <\/p><h2>Article 7: Right of withdrawal<\/h2><ol><li>Consumers can dissolve a contract relating to the purchase of a product through the web shop during a 14-day cooling-off period without giving reasons.<\/li><li>There is no recall right on products purchased directly from the store. These products may only be exchanged at the store for another product of the same value. <\/li><li>The cooling-off period from paragraph 1 begins on the day after:<ol><li>the consumer, or a third party designated in advance by the consumer, other than the carrier, has received the product, or;<\/li><li>the day on which the consumer or a third party designated by the consumer, who is not the carrier, received the last item, if the consumer ordered multiple items in the same order to be delivered separately; or<\/li><li>the day on which the consumer or a third party designated by the consumer, other than the carrier, received the last shipment or part if the delivery of an item consists of multiple shipments or parts; or<\/li><li>the day on which the consumer or a third party designated by the consumer, who is not the carrier, received the first item for a contract for the regular delivery of items during a specified period;<\/li><\/ol><\/li><li>The consumer shall exercise the right referred to in paragraph 1 by sending the completed rescission form, or any other unequivocal statement to that effect, to Woofsplace within the period specified in that paragraph.<\/li><li>If the consumer makes a declaration of dissolution electronically via the Woofsplace website, Woofsplace will confirm receipt of this declaration on a durable data carrier without delay.<\/li><li>The consumer has the burden of proof for the correct and timely exercise of the right referred to in paragraph 1.<\/li><\/ol><h2>Article 8: Obligations during the reflection period<\/h2><ol><li>During the reflection period, the consumer will handle the product and its packaging with care. The consumer will only unpack or use the product to the extent necessary to establish the nature, characteristics and operation of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a store.  <\/li><li>The consumer is only liable for depreciation of the product resulting from handling the product beyond what is permitted, as defined in paragraph 1.<\/li><\/ol><h2>Article 9: Exercise of right of withdrawal including costs<\/h2><ol><li>When exercising the right of withdrawal, the consumer undertakes to notify the entrepreneur within the withdrawal period by means of the model withdrawal form or by other unambiguous means.<\/li><li>At the latest within the period of 14 days from the day following the notification referred to in paragraph 1, the consumer returns the product, or hands it over to Woofsplace. The consumer has complied with the return period in any case if he returns the product before the cooling-off period has expired. <\/li><li>The consumer will return the product with all delivered accessories, if reasonably possible in its original condition and packaging, and in accordance with the reasonable and clear instructions provided by Woofsplace.<\/li><li>The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.<\/li><li>The consumer shall bear the direct cost of returning the product, unless the parties have agreed otherwise in writing.<\/li><li>If the consumer exercises his right of withdrawal, all additional contracts are dissolved by operation of law.<\/li><\/ol><h2>Article 10: Obligations of Woofsplace in case of revocation<\/h2><ol><li>Woofsplace will reimburse all payments made by the consumer, including any delivery costs charged by Woofsplace for the returned product, promptly but at the latest within 14 days following the day on which the consumer notifies him of the withdrawal. Unless Woofsplace offers to pick up the product itself, Woofsplace may wait with refunding until it has received the product or until the consumer proves that he has returned the product, whichever is earlier. <\/li><li>Woofsplace will use the same means of payment used by the consumer for the refund, unless the consumer agrees to another method. The refund is free of charge to the consumer. <\/li><li>If the consumer has chosen a more expensive method of delivery than the least expensive standard delivery, Woofsplace does not have to refund the additional costs for the more expensive method.<\/li><\/ol><h2>Article 11: The Price<\/h2><ol><li>The prices mentioned in the offer of products or services include VAT.<\/li><li>During the validity period stated in the offer, the prices of the products and\/or services offered will not be increased, unless the price changes are due to changes in VAT rates.<\/li><\/ol><h2>Article 12: Conformity and Warranty<\/h2><ol><li>Woofsplace guarantees that the products and\/or services comply with the agreement, the specifications stated in the offer, with the reasonable requirements of soundness and\/or usability and the legal provisions and\/or government regulations existing on the date of the conclusion of the agreement.<\/li><li>An additional warranty provided by Woofsplace, its supplier, manufacturer or importer never limits the legal rights and claims that the consumer can assert against Woofsplace under the agreement if Woofsplace has failed to fulfill its part of the agreement.<\/li><li>Additional warranty means any undertaking by Woofsplace, its supplier, importer or manufacturer in which it grants the consumer certain rights or claims beyond what it is legally obliged to do in the event that it has failed to fulfill its part of the agreement.<\/li><\/ol><h2>Article 13: Delivery and execution.<\/h2><ol><li>Woofsplace will take the utmost care when receiving and executing orders for products or providing services.<\/li><li>The place of delivery is the address that the consumer made known to Woofsplace when ordering the product.<\/li><li>Woofsplace will execute accepted orders expeditiously but at the latest within 30 days, unless the parties have agreed on a different delivery period. If the delivery is delayed, or if an order is not or only partially carried out, the consumer will be informed within 30 days after the order was placed. In that case, the consumer has the right to dissolve the agreement without cost.  <\/li><li>After dissolution in accordance with the previous paragraph, Woofsplace will promptly refund the amount paid by the consumer.<\/li><li>The risk of damage and\/or loss of products rests with Woofsplace until the moment of delivery to the consumer or a representative designated in advance and made known to Woofsplace, unless expressly agreed otherwise.<\/li><\/ol><h2>Article 14: Payment<\/h2><ol><li>Amounts due for services rendered with respect to the groomer or the purchase of products from the physical store, must be paid to Woofsplace immediately upon execution by the consumer.<\/li><li>The amounts due in respect of products purchased through the Woofsplace webshop (at a distance) must be paid by the consumer no later than 14 days after the start of the cooling-off period, or in the absence of a cooling-off period no later than 14 days after the conclusion of the agreement.<\/li><li>The consumer has a duty to promptly report inaccuracies in payment information provided or listed to Woofsplace.<\/li><li>If the consumer does not timely fulfill his payment obligation(s), the consumer is in default without further notice. From the moment of default, the consumer will owe statutory interest on the outstanding amount. <\/li><li>After the invoice term has expired, a free reminder with notice of collection costs is sent with a payment term of 14 days. If the consumer has not paid within the period of the free reminder, a reminder is sent in which the legal collection costs are listed. The consumer is given the time to pay the amount due and the legal collection costs within 14 days. These collection costs amount to a maximum of: 15% over outstanding amounts up to \u20ac 2,500; 10% over the next \u20ac 2,500 and 5% over the next \u20ac 5,000 with a minimum of \u20ac 40.   <\/li><li>If payment is not made, the bailiff is called in. These costs are recovered from the consumer. <\/li><li>In the event that the consumer fails to fulfill his payment obligations, Woofsplace may suspend, discontinue or cancel the agreed work.<\/li><\/ol><h2>Article 15: Liability<\/h2><ol><li>The liability of Woofsplace with respect to the sale and delivery of items is expressly limited to the warranty regulated under Article 12.<\/li><li>If the consumer provides incorrect and \/ or incomplete information to Woofsplace, Woofsplace is not liable for the resulting damage. This also applies to information that is provided too late to Woofsplace. <\/li><\/ol><h2>Article 17: Complaints procedure<\/h2><ol><li>Woofsplace has a sufficiently publicized complaint procedure and will handle the complaint in accordance with this complaint procedure. Complaints about the performance of the agreement must be submitted to Woofsplace within 10 working days fully and clearly described, after the consumer has found the defects. This does not suspend the payment obligation of the consumer.  <\/li><li>Complaints submitted to Woofsplace will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Woofsplace will respond within 14 days with a notice of receipt and an indication of when the consumer can expect a more detailed answer. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure.  <\/li><\/ol><h2>Article 18: Applicable law and choice of forum<\/h2><ol><li>All agreements between Woofsplace and the consumer are governed by Dutch law.<\/li><li>The consumer and Woofsplace will only appeal to court after they have done their utmost to settle a dispute by mutual agreement. Then the Dutch court will be competent to take cognizance of disputes arising from this agreement. <\/li><li>All disputes related to the agreement between Woofsplace and the consumer shall be settled by the District Court of Noord-Holland, subdistrict sector, location Haarlem.<\/li><\/ol><h2>Article 19: Final provisions<\/h2><ol><li>Pricing errors, text or printing errors and clearance sales are reserved.<\/li><li>Additional provisions or provisions deviating from these general conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.<\/li><li>Where one or more of the paragraphs in whole or in part of these terms and conditions is or are found to be inoperative, destroyed or void, all other paragraphs and\/or the remaining portions of the affected paragraphs shall retain their full effect.<\/li><li>Woofsplace has the right to change these terms and conditions and the content of the site.<\/li><\/ol><p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>WoofsplaceHilbersplein 781944 RX Beverwijk Phone number : 06 291 34 967E-mail address : info@woofsplace.nlWebsite : www.woofsplace.nl Chamber of Commerce number : 74071440VAT identification number : NL859763511B01 Article 1: Definitions.
